1. The service
Yachay (operated by Chicha Technology LLC, a US Delaware company) runs your fine-tuning job against open-source base models on Google Cloud Vertex AI Tuning, then delivers the resulting model weights to you via signed download URL.
2. Your data, your model
You own your training data and the resulting tuned weights. We claim no intellectual-property interest in either. Use of the tuned weights is subject to the upstream base model’s license, which is summarized in the model catalog and linked in full from each model’s detail page.
3. Acceptable use
You agree not to use Yachay to train models for:
- Generating child sexual abuse material.
- Creating non-consensual intimate imagery of real people, including deepfake nudity.
- Operating weapons-grade biological, chemical, radiological, or nuclear research without prior written authorization.
- Mass-scale automated harassment, fraud, or impersonation campaigns.
Violations terminate your account and forfeit any pre-paid balance and outstanding receivable.
4. Billing
Each job is metered against Vertex AI runtime plus GCS storage. Pricing is the schedule on the pricing page in effect at submit time. You save a single payment method on file via Stripe; no money moves until a job completes. On successful completion we issue a Stripe invoice for the realized price and Stripe charges your saved card off-session. No upfront bond, no separate Checkout per submit.
If you cancel mid-run, you are billed only for the realized compute consumed up to the moment of cancellation (pro-rated at the same per-class GPU rate that would have applied on completion). There is no flat cancellation fee.
Per-job caps tier with your payment history: new accounts cap at $500/job and auto-promote to $2,000 after 3 completed jobs without an open dispute, then to $5,000 once you reach 5 completed jobs and $10,000 lifetime spend. Caps above $5,000 require enterprise pre-approval in writing.
5. Refunds
No invoice is issued for jobs that fail due to Yachay infrastructure issues (orchestrator error, missing adapter artifact, GCS outage on our side) — the invoice path runs only on successful finalization, and because billing is charge-at-completion against your card on file, "no invoice" literally means "no charge." If a charge already cleared and the job is subsequently marked failed for an infrastructure reason, we refund automatically; the dashboard shows the refund confirmation with the Stripe refund ID. If a refund doesn’t appear on your card within 10 business days, email hello@condorbox.ai with your job ID and we’ll reconcile manually. We do not refund jobs that fail because of dataset issues that passed the linter but produced no usable adapter, nor jobs whose tuned model didn’t meet your accuracy expectations.
6. Service availability
Yachay is provided as-is. We target high availability but make no SLA promises during the pre-launch and v1 phases. Planned maintenance is communicated via email at least 48 hours in advance unless it’s an emergency security patch.
7. Limitation of liability
To the maximum extent permitted by law, Chicha Technology LLC is not liable for indirect, incidental, or consequential damages arising from Yachay use. Aggregate liability is capped at the amount you’ve paid Yachay in the 12 months preceding the claim.
8. Governing law
Delaware law, USA. Disputes resolved in Delaware state or federal courts. You waive the right to a jury trial and to class actions.
9. Changes
Material changes get 30 days’ notice via email. Continued use after the effective date constitutes acceptance.
